$6 MILLION VERDICT IN MISSOURI MEDICAL MALPRACTICE CASE
A recent article from JusticeNewsFlash.com reports that $6 million dollar jury verdict was recovered in a medical malpractice case by a family out of the St. Louis, Missouri area. The doctors of the family's six month-old baby were found liable for the wrongful death of the baby after failing to diagnose and treat a bacterial infection in the baby.
The article also mentions Missouri's $350,000 medical malpractice cap currently in place. However, the $6 million case was filed before the cap took effect. Comparatively, Indiana caps medical malpractice claims at $1,250,000 total. IC 34-18-14-3(a). However, a doctor or health care provider cannot be liable for more than $250,000. IC 34-18-14(b). The excessive judgment or settlement comes out of Indiana's Patient's Compensation Fund. IC 34-18-14-3(c).
